The dominant social scientific approach to studying judicial behavior treats judges as strategic actors pursuing their political preferences under institutional constraint. The intellectual roots of this rational choice approach are in American law’s long but sporadic engagement with pragmatist ideas. This article challenges that approach: a fully pragmatist account of judicial action provides a better description of the intellectual and social work of judging, and better explains how judges reach a decision in difficult cases that most affect the development of (...) law and its relationship to society. The article argues that the foundational intellectual problem for appellate judges is how to define the legal questions presented in a case. Definitions of legal questions arise from the interplay of habitual and creative action in the local social context of an appeals court. Professional and local interpretive habits and legal forms ordinarily do a great deal to define the key questions, which are not strictly determined when a case comes before a court. Unscripted small group interactions at oral arguments also figure in question definition; oral arguments are most important in the rare but legally important cases where habitual practices alone are insufficient to delimit the legal question judges must answer. Supported by extensive interviews with federal appeals judges and clerks, the article illustrates judges’ creative, interactional efforts to define an answerable question in a major asylum case decided in the Seventh Circuit Court of Appeals. Building from this case, the article describes the factors that shape judicial question definition, and describes the conditions when creative judicial action is likely to be most prominent. 'Modernity' has come to refer both to a contested historical category and to an even more contested philosophical and civilisational ideal. In this important collection of essays Robert Pippin takes issue with some prominent assessments of what is or is not philosophically at stake in the idea of a modern revolution in Western civilisation, and presents an alternative view. Professor Pippin disputes many traditional characterisations of the distinctiveness of modern philosophy. In their place he defends claims about agency, freedom, ethical (...) life and modernity itself, all of which are central to the German idealist philosophical tradition, and in particular, to the writings of Hegel. With the rise of review sites and social media, films today, as soon as they are shown, immediately become the topic of debates on their merits not only as entertainment, but also as serious forms of artistic expression. Philosopher Robert B. Pippin, however, wants us to consider a more radical proposition: film as thought, as a reflective form. Pippin explores this idea through a series of perceptive analyses of cinematic masterpieces, revealing how films can illuminate, in a concrete manner, core (...) features and problems of shared human life. Filmed Thought examines questions of morality in Almodóvar’s Talk to Her, goodness and naïveté in Hitchcock’s Shadow of a Doubt, love and fantasy in Sirk’s All That Heaven Allows, politics and society in Polanski’s Chinatown and Malick’s The Thin Red Line, and self-understanding and understanding others in Nicholas Ray’s In a Lonely Place and in the Dardennes brothers' oeuvre. In each reading, Pippin pays close attention to what makes these films exceptional as technical works of art and as intellectual and philosophical achievements. Among moral attributes true virtue alone is sublime. … [I]t is only by means of this idea [of virtue] that any judgment as to moral worth or its opposite is possible. … Everything good that is not based on a morally good disposition … is nothing but pretence and glittering misery. 1.

In the Critique of Pure Reason, Kant refers often and with no apparent hesitation or sense of ambiguity to the mind. He does so not only in his justly famous destruction of rationalist proofs of immaterialism, but throughout his own, positive, ‘transcendental’ account in the Transcendental Aesthetic and Transcendental Analytic. In the first edition of the Critique, he even proposed what he adventurously called a ‘transcendental psychology’ and, although this strange discipline seemed to disappear in the second edition, he left (...) in that edition all his frequent references to forms ‘lying in the mind,’ and to the mind, or the self, or the subject of experience, or the ego, doing this or that. Curiously, though, despite an extensive secondary literature, there is in that literature relatively little discussion of what these expressions, in a proper, strictly Kantian sense, are supposed to refer to. There are two imaginative, extremely suggestive articles by Sellars, some hints at connections with eighteenth century psychology offered by Weldon, a tenebrous book by Heidemann, and some recent attention to the general issue of ‘Kant's theory of mind’ by Ameriks and Kitcher. Anthropology, History, and Education, first published in 2007, contains all of Kant's major writings on human nature. Some of these works, which were published over a thirty-nine year period between 1764 and 1803, had never before been translated into English. Kant's question 'What is the human being?' is approached indirectly in his famous works on metaphysics, epistemology, moral and legal philosophy, aesthetics and the philosophy of religion, but it is approached directly in his extensive but less well-known writings on physical (...) and cultural anthropology, the philosophy of history, and education which are gathered in the present volume. Kant repeatedly claimed that the question 'What is the human being?' should be philosophy's most fundamental concern, and Anthropology, History, and Education can be seen as effectively presenting his philosophy as a whole in a popular guise. This fresh and original book argues that the central questions in Hegel's practical philosophy are the central questions in modern accounts of freedom: What is freedom, or what would it be to act freely? Kant's anthropological works represent a very different side of his philosophy, one that stands in sharp contrast to the critical philosophy of the three Critiques. For the most part, Kantian anthropology is an empirical, popular, and, above all, pragmatic enterprise. After tracing its origins both within his own writings and within Enlightenment culture, the Element turns next to an analysis of the structure and several key themes of Kantian anthropology, followed by a discussion of two longstanding contested features - viz., (...) moral anthropology and transcendental anthropology. The Element concludes with a defense of the value and importance of Kantian anthropology, along with replies to a variety of criticisms that have been levelled at it over the years. The following is a chapter of a book and I should say something at the outset about the content of the book. The topic is Hegel’s “social theory of agency,” and that topic, given how the problem of agency is usually understood, raises the immediate question of why anyone would think that “sociality” would have anything at all to do with the “problem of agency.” That problem is understood in a number of ways; most generally – what distinguishes naturally occurring (...) events from actions (if anything)? (Sometimes the question is: what, if anything, distinguishes responsible human doings from what animals do?) The most prominent approach has it that actions are things done intentionally by individuals, purposely, for a purpose. This is sometimes said to mean: acting from or on or because of an intention, although as we shall see this nominalization can be quite misleading. Or, of the many possible descriptions of some occurrence, it is an action is there is a true description which is intentional. This is often taken to mean simply that if you ask a person why he is doing something he can express this intention to explain himself, most often in the form of a reason. He does not (except in extraordinary circumstances) describe why he is acting in the way he might describe what caused his.. (shrink)

One of the most important developments in the theory of knowledge during the past two decades has been a shift in emphasis to concern with issues of the reliability of various processes of belief formation. One way of arriving at beliefs is more reliable than another in a specified set of circumstances just insofar as it is more likely, in those circumstances, to produce a true belief. Classical epistemology, taking its cue from Plato, understood knowledge as justified true belief. While (...) Gettier had raised questions about the joint sufficiency of those three conditions, it is only more recently that their individual necessity was seriously questioned. What I will call the "Founding Insight" of reliabilist epistemologies is the claim that true beliefs can, at least in some cases, amount to genuine knowledge even where the justification condition is not met (in the sense that the candidate knower is unable to produce suitable justifications), provided the beliefs resulted from the exercise of capacities that are reliable producers of true beliefs in the circumstances in which they were in fact exercised. In this book, Robert Talisse critically examines the moral and political implications of pluralism, the view that our best moral thinking is indeterminate and that moral conflict is an inescapable feature of the human condition. Through a careful engagement with the work of William James, Isaiah Berlin, John Rawls, and their contemporary followers, Talisse distinguishes two broad types of moral pluralism: metaphysical and epistemic. After arguing that metaphysical pluralism does not offer a compelling account of value and thus cannot ground (...) a viable conception of liberal politics, Talisse proposes and defends a distinctive variety of epistemic pluralism. According to this view, certain value conflicts are at present undecidable rather than intrinsic. Consequently, epistemic pluralism countenances the possibility that further argumentation, enhanced reflection, or the acquisition of more information could yield rational resolutions to the kinds of value conflicts that metaphysical pluralists deem irresolvable as such. Talisse’s epistemic pluralism hence prescribes a politics in which deep value conflicts are to be addressed by ongoing argumentation and free engagement among citizens; the epistemic pluralist thus sees liberal democracy is the proper political response to ongoing moral disagreement. In this paper, the author engages William Galston's recent attempt to revive the Berlinian project of developing a comprehensive theory of liberalism from value pluralist premises. The author's argument maintains that, despite Galston's attempts, the value pluralist in fact has no resources with which to recommend a liberal political order over a variety of illiberal regimes, and that, further, Galston's own justificatory strategy is indistinguishable from the later Rawls's noncomprehensive, ‘political' liberalism. Although the argument engages the work of Berlin and (...) Galston in particular, the primary aim is to preserve the intuition, common to Rawls, Brian Barry, Ronald Dworkin, and John Gray, that value pluralism is inconsistent with comprehensive liberalism. Important features of the self-concept can be located outside of the individual and inside close or related others. The authors use this insight to reinterpret data previously said to support the empathy-altruism model of helping, which asserts that empathic concern for another results in selflessness and true altruism. That is, they argue that the conditions that lead to empathic concern also lead to a greater sense of self-other overlap, raising the possibility that helping under these conditions is not selfless but (...) is also directed toward the self. In 3 studies, the impact of empathic concern on willingness to help was eliminated when oneness--a measure of perceived self-other overlap--was considered. Path analyses revealed further that empathic concern increased helping only through its relation to perceived oneness, thereby throwing the empathy-altruism model into question. The authors suggest that empathic concern affects helping primarily as an emotional signal of oneness. (shrink)

This is the most important book on Hegel to have appeared in the past ten years. The author offers a completely new interpretation of Hegel's idealism that focuses on Hegel's appropriation and development of Kant's theoretical project. Hegel is presented neither as a pre-critical metaphysician nor as a social theorist, but as a critical philosopher whose disagreements with Kant, especially on the issue of intuitions, enrich the idealist arguments against empiricism, realism, and naturalism. Several distinct epistemic states may be properly characterized as states of ?ignorance.? It is not clear that the ?public ignorance? on which Jeffrey Friedman bases his critique of social democracy is objectionable, because it is not evident which of these epistemic states is at issue. Moreover, few extant theories of democracy defend it on the grounds that it produces good outcomes, rather than because its procedures are just. And even the subcategory of democratic theories that focus on epistemic issues take (...) the state of epistemic justification, not the condition of reaching the truth, to be the touchstone of democratic legitimacy.
